The Land Compensation Board is a quasi-judicial board established by the Expropriation Act.

Other applications that require a decision or order of the Board may be commenced by filing a Notice of Motion. Examples of these applications include requests for the Board to:

(a)   Determine a proposed payment (Expropriation Act, section 36);

(b)   Determine costs where compensation has been settled (Expropriation Act, section 39);

(c)   Direct that compensation be paid into Court (Expropriation Act, section 40); and

(d)   Terminate an interest acquired (Expropriation Act, section 70).

When an Application for Determination of Compensation (ADC) has been filed, interim applications, applications to decide procedural issues and applications to decide items after the compensation hearing should be initiated by a Notice of Motion.
